Terms of Agreement

I. GENERAL TERMS

I reserve the right to decline any request for commissions without any reason or explanation whatsoever.
All communications between myself and the client will be conducted via e-mail, if contact started on social media it will be moved to be via e-mail for my safety and the client’s.
Any and all personal information received will be kept private and confidential.
Any and all ill behavior will not be tolerated and your commission will be canceled without further warning if it occurs.
If you fail to follow any of the rules provided, I have the right to decline your commission.

All commissions must be paid in full upfront.
Unless otherwise discussed and agreed upon, the currency accepted is through PayPal, in USD (United States Dollar).
All payments are made via PayPal invoices.
Any invoices will be sent to the client once the details of the commission(s) have been determined.
The client has one week to make their full payment. Otherwise, the commission will be canceled.

The time for the commission to be completed can be 3-8 weeks, it’s dependent on the scope of the commission. The time frame will be discussed with the customer.
Only one small or large revision will be accepted during the sketch phase of the commission.
Only two small revisions will be accepted during the coloring phase of the commission.
I will not accept large revisions after the commission’s sketch phase.
I will not, under any circumstances start the commission until payment and references have been received and cleared.
A Rush Job or Expediting commissions will have an extra fee.

After a commission is finished small changes can be made.
Such as small coloring/marking mistakes.
However, any large changes will come with an extra charge.
Such as an outfit change, background change or anything that makes me have to redraw it completely.
Clients have one month from the date of completion to contact me after the piece is completed.
If your reference was unclear to start with, then you are not allowed to do minor changes without a fee.
Please make sure to be clear in your descriptions.

I have the right to cancel and refund the money for your commission at any given time.
Full refunds are only issued at the start of the commission, before the first sketch is sent.
If the client wishes to cancel a commission, the refunded amount will be determined by how much work has been completed. The client will receive what has been completed up until the point of refund.
Commissions will be completed in the order that I receive payment and references.

I reserve full rights to the image and its distribution.
I’m allowed to use the copyrighted commission to:
Promote myself at any place or site.
Publish books or any physical media with it.
Displaying them in my portfolio.
Post them wherever I want.
The client is allowed to:
Use the copyrighted artwork for personal use only, unless an agreement is reached otherwise.
Print the art, and claim the right of their character(s) but not the drawing itself.
Use the art to promote themselves with proper credit given to the artist.
If you break the copyright infringement in any way, every right you had to the drawing will be retracted.
The following is considered Copyright infringement:
Reproducing or using the copyrighted artwork commercially. (Meaning making money off of it in any way)
Taking credit for the creation of the artwork.
Removing or obscuring any watermarks or signatures.
The client has the right to buy commercial rights to the commissioned art.
Details would be discussed individually.
With commercial rights you are allowed to make any sort of merchandise with the artwork.
Use it in books, covers, as props, change it to your liking and promote your own brand with it.
Credit is still required for usage of the artwork, even if altered or edited.
I retain no responsibility or liability for what the client or third parties do with the commission once it is done.
